How Delaware State Income Tax Works

Delaware uses a progressive bracket system with seven brackets ranging from 0% to 6.6% in 2026. Unlike some states, Delaware uses the same bracket schedule for all filing statuses — only the standard deduction differs between single and married filers.

Key features of the Delaware income tax system:

  • Standard deduction — $3,250 for single filers; $6,500 for married filing jointly. This is much smaller than the federal standard deduction ($16,100 single in 2026), so Delaware taxes more of your income at the state level.
  • Personal exemption credit — $110 per exemption applied directly against calculated tax. Single filers get 1 credit ($110); MFJ filers get 2 credits ($220). Plus $110 per qualifying dependent.
  • Retirement income exclusion — Delaware residents age 60 and older can exclude up to $12,500 of pension, IRA, or eligible retirement income from state tax. Under 60: up to $2,000 exclusion.

Wilmington City Wage Tax — Impact on Annual Tax Liability

Wilmington's 1.25% city wage tax applies to earned income for both residents and non-residents working within city limits. On an annual basis:

Retirement Income and Delaware Taxes

  • Social Security benefits: Delaware does not tax Social Security benefits. 100% of Social Security income is excluded from Delaware gross income, regardless of your total income level. This applies to all Delaware residents — there is no income-based phase-out of the Social Security exclusion.
  • Pension and retirement income exclusion (age 60+): Delaware residents aged 60 and older may exclude up to $12,500 per person of pension and eligible retirement income from Delaware taxable income. Eligible income includes private pensions, government pensions, IRA distributions, 401(k) withdrawals, and annuity income. A married couple both age 60+ can exclude up to $25,000 combined.
  • Retirement income exclusion (under age 60): Delaware taxpayers under age 60 may exclude up to $2,000 of pension or retirement income — a much smaller exclusion. Workers approaching retirement should be aware that the exclusion increases sharply at age 60.
  • Military retirement pay: Military retirement income qualifies for the same $12,500 exclusion (age 60+) or $2,000 exclusion (under 60) that applies to civilian pensions. Delaware does not provide a separate, unlimited military retirement exclusion.
  • Roth IRA distributions: Qualified Roth IRA distributions are treated the same as under federal rules — tax-free in Delaware if qualified.

Example: A 65-year-old Delaware single filer with $30,000 in Social Security and $20,000 in IRA distributions can exclude all $30,000 of Social Security and up to $12,500 of the IRA. Only $7,500 of the IRA distribution is Delaware taxable — at 5.55%–6.6% brackets, resulting in a very low effective state tax on retirement income.

Delaware Tax Credits and Deductions

Delaware's tax credit and deduction landscape is modest compared to many states, but several items are worth noting for annual filers:

  • Standard deduction: $3,250 (single) / $6,500 (MFJ). This is significantly smaller than the federal standard deduction, so Delaware taxes more of your income than the federal return. Delaware does not conform to the federal standard deduction amount.
  • Personal exemption credit: $110 per exemption (1 for single filers, 2 for MFJ) and $110 per qualifying dependent. Applied as a direct credit against tax owed — not a deduction. A single filer with two dependents claims $330 in exemption credits.
  • No state EITC: Delaware does not have a state Earned Income Tax Credit. Delaware residents who qualify for the federal EITC do not receive a Delaware EITC.
  • Itemized deductions: Delaware allows itemized deductions on Form 200-01, including property taxes paid, charitable contributions, and certain medical expenses. Delaware does not conform to all federal itemized deduction limits — some items deductible in Delaware may be capped differently than on the federal return.
  • Delaware filing form and deadline: Delaware personal income tax is filed on Form 200-01 (residents) or Form 200-02 (nonresidents). The Delaware filing deadline is April 30 — not April 15 like most states. Tax owed is also due by April 30. Delaware does offer extensions for filing (but not for payment).
